1. Object of the contract
These General Conditions are for the purchase of products and services, made remotely via the Internet on the site "www.gioielleriaemmegi.com" owned by EMMEGI S.r.l. based in San Filippo del Mela, VAT number. 02127750830
Each purchase transaction will be governed by the provisions of Legislative Decree no. 185/99 and, as regards the protection of confidentiality, will be subject to the legislation referred to in Law no. 675/96 and subsequent modifications.
Below are the sales conditions that will remain effective until they are changed by the supplier. Any changes to the terms of sale will be effective from the time they are published on the website and refer to sales made from that moment on.
2. Acceptance of the general conditions of sale
The contract stipulated between EMMEGI S.r.l. and the Customer must be considered concluded with the acceptance, of the order by EMMEGI S.r.l.. This acceptance is considered tacit, if not otherwise communicated with any modality to the Customer. By placing an order in the various ways provided, the Customer declares to have read all the information provided to him during the purchase procedure, and to fully accept the terms and conditions of payment below. If the Customer is a consumer (ie a natural person who buys the goods for purposes not related to his professional activity), once the purchase process is completed, he will print or save an electronic copy and otherwise keep these general conditions of sale , in compliance with the provisions of Articles 3 and 4 of Legislative Decree 185/1999 on distance sales and, as regards the protection of confidentiality, will be subject to the legislation referred to in Law no. 675/96 and subsequent modifications. Any right of the Customer to compensation for damages or compensation is excluded, as well as any contractual or extra-contractual liability for direct or indirect damage to persons and / or property caused by the non-acceptance, even partial, of an order.
3. Sales prices
The displayed sales prices are among the best quality / price offers on the Italian market, because we operate with large purchase volumes and guarantee quality and professionalism of the items thanks to the accumulated experience and the continuous research of our technicians and salesmen.
All sales prices of the products displayed and indicated on the website, for which they constitute an offer to the public pursuant to art. 1336 of the Civil Code, are inclusive of I.V.A. and any other tax. It will be charged to the customer a contribution for shipping costs, clearly displayed before the completion of the order, variable in relation to weight, size and destination (on Italian or foreign territory) of the order; as for the destination abroad, it will be the responsibility of the consumer and / or customer to verify the additional costs related to the State in which the delivery must be made by sending a specific written request via e-mail or fax.
4. Purchase methods
The Customer can purchase the products in the online catalog at the time of placing the order as described in the relevant information sheets. It is understood that the image accompanying the description of a product may not be fully representative of its characteristics but may differ in color, size and accessory products in the figure. All the information supporting the purchase are intended as simple general information material, not referable to the real characteristics of a single product. The correct order is confirmed by EMMEGI S.r.l. by an e-mail reply sent to the e-mail address provided by the Customer. This confirmation message will include an 'Order Number', to be used in any further communication with EMMEGI Srl. The message re-proposes all the data entered by the Customer who undertakes to verify its correctness and promptly communicate any corrections, according to the procedures described in this document . In case of non-acceptance of the order, EMMEGI S.r.l. ensures timely communication to the Customer. For any complaints please contact us by email at email@example.com.
5. Right of withdrawal
Pursuant to art. 5 DL 185/1999, if the customer is a consumer (ie a physical person who purchases the goods for purposes not related to his professional activity, or does not make the purchase by indicating in the order form to EMMEGI Srl a reference of VAT number ), has the right to withdraw from the purchase contract for any reason, without the need to provide explanations and without any penalty, except as indicated in the following point. To exercise this right, the customer must send to EMMEGI S.r.l. a notice to that effect, within 10 working days from the date of receipt of the goods. This communication must be sent by registered letter with acknowledgment of receipt, addressed to EMMEGI S.r.l. or by telegram or fax always sent within the aforementioned term of 10 days and followed by a confirmation by registered letter with acknowledgment of receipt, sent TASSATIVELY within the following 48 hours. Once the aforementioned withdrawal notice has been received, EMMEGI S.r.l. will promptly communicate to the customer the instructions on how to return the goods that must be sent to EMMEGI S.r.l. within 10 days of the authorization. The right of withdrawal is however subject to the following conditions: the right applies to the product purchased in its entirety; it is not possible to exercise withdrawal only on part of the product purchased (eg: accessories, etc ...); the purchased good must be intact and returned in the original packaging, complete in all its parts (including packaging and any documentation and accessory equipment: manuals, cables, etc ...); to limit damage to the original packaging, we recommend, when possible, to put it in a second box, showing the RMA number (return authorization code); in all cases, the affixing of labels or adhesive tapes directly onto the original packaging of the product should be avoided; according to law, the shipping costs related to the return of the asset are charged to the customer; the shipment, until the certificate of receipt in our warehouse, is under the complete responsibility of the customer; in case of damage to the goods during transport, EMMEGI S.r.l. will notify the customer of the event (within 5 working days of receipt of the goods in their stores), to allow him to promptly report to the courier chosen by him and obtain the reimbursement of the value of the asset (if insured); in this case, the product will be made available to the customer for his return, simultaneously canceling the request for withdrawal; EMMEGI S.r.l. not responsible in any way for damage or theft / loss of goods returned by uninsured shipments; upon its arrival in the warehouse, the product will be examined to assess any damage or tampering not caused by transport. If the packaging and / or the original packaging are damaged, EMMEGI S.r.l. will deduct from the refund due a percentage, however not exceeding 10% of the same, as a contribution to the costs of restoration. Without prejudice to any restoration costs for damage ascertained to the original packaging EMMEGI S.r.l. will refund the customer the amount already paid, in the shortest possible time and in any case within 30 days from the request for withdrawal, by means of a transfer of the amount charged to the credit card or by bank transfer. In the latter case, the customer will promptly provide the bank details on which to obtain the reimbursement (ABI Code - CAB - Current Account of the invoice). The right of withdrawal is totally lost, due to the lack of the essential condition of integrity of the goods (packaging and / or its content), in cases where EMMEGI S.r.l. make certain: the lack of the external packaging and / or the original internal packaging; the absence of integral elements of the product (accessories, cables, manuals, parts, etc.); damage to the product for reasons other than transport. In case of forfeiture of the right of withdrawal, EMMEGI S.r.l. will return the purchased good to the sender, charging him the shipping costs.
6. Availability of products
The computer system of the site is designed to guarantee the immediate fulfillment of orders and to avoid unnecessary waiting for the customer; it, in fact, indicates in real time, in its electronic catalog, the physical availability of the product and the possible condition of unavailability. If an order exceeds the quantity existing in the warehouse, the computer system will allow to bring "at the cash desk", buy and receive only the quantities that are stored in the set time. It may happen that two simultaneous orders do not allow availability updates.
In the case of offers with discounts, any lack of the product will not result in the cancellation of the order and therefore the loss of the benefit and the evasion of the same will take place in accordance with the law (Legislative Decree No. 206/2005). If the customer does not consent to wait for the time necessary for delivery (after the deadline set by Article 54 of Legislative Decree No. 206/2005), the contract will be terminated and immediate payment will be made.
7. Delivery methods
EMMEGI S.r.l., will deliver to customers the selected and ordered products, in the manner described above, by couriers and / or shippers of trust. Delivery times will never exceed those provided for by art. 54 of Legislative Decree 206/2005 (this term will also be applicable to transactions with non-consumers). By date of delivery we mean the date on the first attempt, by the courier, to deliver the goods to the address (to be considered the main entrance of the building and not that of access to the private home), even if the attempt is not successful due to absence of the recipient or refusal of the goods.
In August, due to the reduction in services provided by couriers, shipments may be delayed 24/48 hours compared to expected delivery. In case of non-delivery of ordered and shipped goods not attributable to EMMEGI S.r.l., the same will have the right to reimbursement of transport costs.
This repayment transaction can also be carried out by partial transfer of the payment made by credit card. In case of damage to the package or packaging, the Customer has the burden of affixing reservations to the items transported at the time of return, under penalty of forfeiture. The customer from the moment he receives the damaged goods or asks for the return to the carrier has direct and exclusive action against the carrier.
The latter also responds to the delay in delivering the goods to the recipient. EMMEGI Srl, in such cases, must be considered exempt from any responsibility for losses or damage (damage) of the goods from the moment in which the same is delivered without reservations to the carrier for transportation.In case of partial loss or damage not recognizable at the time of the return, the customer must report to the carrier, under penalty of forfeiture, the damage just known and no later than eight days from receipt by registered mail (Article 1698 of the Civil Code)
Any complaint must be forwarded online to firstname.lastname@example.org. The Customer will receive an e-mail confirming the opening of the complaint within the following three working days; with the same communication will be provided instructions for the definition of the procedure and forwarded requests for clarification or documentation. In compliance with the regulations in force, the Customer / Consumer, in the event of a complaint sent more than six months after delivery of the product, must provide suitable documentation proving that the lack of conformity existed at the time of delivery. For complaints sent within six months of delivery, EMMEGI S.r.l. reserves the right to verify the existence of the defect complained of by the Customer, to be carried out in the relative assistance center used by the seller, before granting the requested remedy or the alternative prescribed by law.
WE DO NOT ACCEPT COMPLAINTS WITHOUT THE RESERVE ON THE SHIPPING LETTER MADE TO THE COURIER AT THE TIME OF THE ARRIVAL OF THE GOODS.
9. Method of payment
To meet all the different needs of users we offer a wide range of payment methods for the products purchased:
- Bank transfer - Upon confirmation of the order will be sent a confirmation e-mail with all the data to make the transfer.
The reason to report on the bank transfer must indicate: the number and date of the order, the company name or the name of the buyer; the coordinates are also reported in the order confirmation email sent automatically to the customer. These General Conditions of Sale are subject to Italian law. Any dispute that does not find a friendly solution will be subject to the exclusive jurisdiction of the Court of the place of residence or domicile of the Customer, if located in the territory of the State.
